Default Getting a Palm Pre, but not from Sprint

So, I want a Palm Pre, and I already have Sprint. However, I don't want to change my plan. I'm on a family plan, and we got a special deal a long time ago that gave us unlimited internet access, texting, and picture mail. So, I see no need to change my plan, yet I can't get the promotional price on the Pre unless we change it.

Here's my question: If I buy a Pre from a third party (such as on Craigslist or eBay or something), will I have any loss of functionality because I didn't change my plan on Sprint? I can't think of a way they could do this, but I'd rather not shell out a few hundred bucks to a non-refundable source to find out I'm screwed. Has anyone done this?

You cannont activate that phone on your plan. Its not about buying it through Sprint and having to upgrade your plan. Its about Sprint wont activate the phone on your plan.

Has anybody tried it? As in buying the phone and activating on the website?
If there's no checks in place it might accept it.

If there's no checks in place it might except it.
That's what I was wondering. If I own a Pre, and activate it on the website, I didn't see how they could prevent me from doing that.
