i currently have a regular cellphone with verizon service. im in the second year of my two year contract, but now i want to buy a treo and get the PDA/Smartphone Voice & Data Choice Bundlessm Core Choice plan. a) can i buy a treo from like ebay and will verizon hook that up with their service? and b) can i just switch to a different plan, namely the voice and data for the treo, without being considered in breach of my contract with verizon, since im switching to a higher plan?

If you buy a phone from eBay, as long as it's a Verizon phone or an unlocked CDMA phone from another carrier you should be okay adding it to your current Verizon service. Before purchasing the phone, you may want to ask the seller for the ESN number. Run that by VZW customer service. My understanding is that if the phone is associated with a delinquent account, they won't activate it. I haven't heard that from VZW, that's just the word on the street.
Rule of thumb is you want to ask questions of all parties involved.
Also, for anyone else reading this, if you purchase an older phone (NON-TREO) make sure you first check with your provider. If the phone is not GPS compliant, they will not activate it on your plan.
With respect to your second question, I'm not sure, but I think they might view this a plan change and might require an 1 year extension. If you were adding data service to an existing plan, you might be able to assert that this was an additional service and not a change to the existing plan, thus no contract, though that might not fly with them.
When I was with Verizon, at the end of the contract term I was on a month-to-month basis, but I'm not sure you can add data at that point without a contract.
